General Terms and Conditions

Balanced Equine reserve the right to change any part of this agreement without notice and your use of Balanced Equine will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement either via the website or by requesting a copy from Joanna. Balanced Equine has complete discretion to modify or remove any part of the web site without warning or liability arising from such action.

By engaging the services of Balanced Equine you agree to be bound by the terms and conditions set out herein. If you object to any of the terms and conditions set out in this agreement you should not use any of the services provided by Balanced Equine.

It is expressly agreed that in any claim against Joanna Heaton in connection with the services she provides whether in contract, negligence or tort the liability for loss or damage in respect to any one horse or pony shall be limited to a maximum of £10,000.00.

 The Agreement by Joanna Heaton to provide services (and any dispute, controversy, proceedings or claim of whatever nature arising out of or in anyway relating to such Agreement or its formation) shall be governed by and construed in accordance with English Law.

Whilst Balanced Equine is providing a service all of the responsibilities and liability of ownership remain with the owner and Joanna Heaton will not be the Keeper of the animal at any time.

It follows that responsibility for the consequences of the animals behaviour will remain those of the owner pursuant to the Animals Act 1971.

Balanced Equine dose not accept any responsibility for loss, damage or injury to you, your horse, personal effects or tack.

All horses should be vaccinated against equine flu and tetanus, be wormed and hold a passport. Failure of the owner to ensure that the horse is vaccinated or wormed is totally the clients own risk.

Payment and Cancellations

A cost of work to be carried out with a clients horse shall be agreed before any work is carried out. Payment in full shall be due at the end of any one off call out session. Any work carried out by Balanced Equine at Thornbank Stables will require full payment at the end of each one off session. Training livery will require the first week to be paid in advance and then all work and any additional costs shall be invoiced at the end of each calendar month.

Payment in full will be required before any horse leaves Thornbank Stables.

Late cancellations made within 24 hours of a session will be charged at a rate of 50%.

If the client fails to turn up to a pre booked session full payment will be required.

Work booked in more than a week in advance will require a non-refundable deposit to be paid.

Balanced Equine does not make allowances for bad weather. However, if it is raining heavily, snowing, a severe ground frost or extremely windy your booking may be transferred to another time at the discretion of Balanced Equine.

 Balanced Equine regret that refunds or compensation in the event of cancellation or alterations as a result of force majeure will not be given. Force majeure is defined as war, threat of war, riot, civil strife, industrial dispute, strike, lock-out, government action, terrorist activity, natural or nuclear disaster, fire, flood and adverse weather conditions.

Booking Terms and Conditions

New clients will be required to fill out an assessment form and sign a disclaimer before any work is carried out with their horse.

On signing an assessment form the client confirms that all information provided in the form is correct to the best of their knowledge and that they have read and agree to abide by the terms and conditions set out in this document. A clause will then exist between the client and Balanced Equine. This clause is governed by English Law and in the unlikely event of a dispute both parties agree to submit to the exclusive jurisdiction of the English courts at all times.

Existing Clients are expected to inform Balanced Equine immediately of any changes to their own or their horse’s circumstances (e.g. change of contact details or health).

Safety

Balanced Equine reserves the right to refuse to work with, ride or supervise anyone riding a horse if there is any question of safety.

Clients will reserve the right to stop any work if they believe it to be unsafe.

Animals are unpredictable. Do not feed or make contact with any animal that does not belong to you whilst under the supervision of Balanced Equine without prior authorisation.

 Children under the age of 18 years must be accompanied and supervised by a responsible adult at all times.

When working with a horse on the ground under the supervision or instruction of Balanced Equine clients are strongly advised to wear a riding hat to current safety standard PAS015 or BSEN1384, suitable footwear (sturdy boots) and gloves.

When riding a horse under the supervision or instruction of Balanced Equine clients must wear a riding hat to current safety standard PAS015 or BSEN1384 and suitable footwear with a heel, trainers, high heels and open toed shoes are not permitted. Clients are also advised to wear a back protector and gloves.

Any jewellery worn at any time around horses is worn totally at your own risk.

Balanced Equine operates a strict no smoking policy. No smoking is allowed whist working with horses under the supervision or instruction of Balanced Equine.

No alcohol or illegal substances should be used whilst working with horses under the supervision or instruction of Balanced Equine. If any one is found to be in the possession of or intoxicated by alcohol or an illegal substance Balanced Equine reserve the right to stop all work with that individual immediately.
