Terms and Conditions
By engaging the services of Balanced Equine you agree to be bound by the terms and conditions set out herein. If you object to any of the terms and conditions set out herein this agreement you should not use any of the services provided by Balanced Equine.
We advise users to regularly check the Terms and Conditions of this agreement either via the website or by requesting a copy from Jo.
It is expressly agreed that in any claim against Balanced Equine in connection with the services provided whether in contract, negligence or tort, the liability for loss or damage in respect to any one equine shall be limited to a maximum of £10,000.
The agreement by Joanna Heaton to provide services and any dispute, controversy, proceedings or claim of whatever nature arising out of or in anyway relating to such agreement or its formation shall be governed by and construed in accordance with Scottish Law.
Whilst Balanced Equine is providing a service all of the responsibilities and liability of ownership remain with the owner.
It follows that responsibility for the consequences of the animal’s behaviour will remain those of the owner pursuant to the Animals Act 1971.
Balanced Equine does not accept any responsibility for loss, damage or injury to you, your horse, personal effects or tack.
All horses should be vaccinated against equine influencer and tetanus, be on a suitable worming programme and hold a passport.
The standard fee for Training livery is to be paid weekly in advance. The first weeks payment is due on arrival and then at weekly intervals throughout the horses stay. Any additional services or extras shall be charged at the industry going rate and are to be paid within seven days of invoice.
The full cost of a one-off training session at Balanced Equine or at a clients yard is required immediately at the end of each session.
All payments are to be made in full before any equine is removed from Balanced Equine.
Invoices and receipts are available on request.
Cancellations for one off training sessions within 24 hours of a session will be charged at a rate of 50%.
If a client fails to turn up to a training session with no prior notice, full payment will be required.
Training livery spaces can be secured with a £100 non-refundable deposit. This sum shall be deducted from the balance owed at the end of the agreement.
Balanced Equine does not make allowances for bad weather. However, if it is raining heavily, snowing, a severe ground frost or extremely windy your booking may be transferred to another date at the discretion of Balanced Equine.
Balanced Equine regret that refunds or compensation in the event of cancellation or alterations as a result of force majeure will not be given. Examples of force majeure include natural disaster, government or social actions and infrastructure failures.
Equines coming on training or any other livery package will be required to have a completed and signed agreement before their stay.
On signing the agreement and assessment form the client confirms that all information is correct to the best of their knowledge and that they have read and agree to abide by the terms and conditions set out in this document. A clause will then exist between the client and Balanced Equine. This clause is governed by Scottish Law and in the unlikely event of a dispute both parties agree to always submit to the exclusive jurisdiction of the Scottish courts.
Existing clients are expected to inform Balanced Equine immediately of any changes to their own or their horses’ circumstances, including change of contact details or health.
Clients reserve the right to stop any work if they believe it to be unsafe.
Animals are unpredictable. Do not feed or make contact with any animal that does not belong to you without prior authorisation.
Children under the age of 18 years must be accompanied and supervised by a responsible adult at all times.
Clients are strongly advised to wear a riding hat to current safety standard, suitable, sturdy footwear and gloves whilst working with a horse on the ground.
When riding, a riding hat to current safety standard and suitable footwear with a small heel must be worn. It is strongly recommended to also wear an up to standard back protector.
Any jewellery worn at any time around horses is worn totally at your own risk.
Balanced Equine operates a strict no smoking policy.
No alcohol or illegal substances should be used whilst working with horses. If anyone is found to be in the possession of or intoxicated by alcohol or an illegal substance Balanced Equine reserve the right to stop all work with that individual immediately.
